Terms and Conditions

1.1 These terms & conditions apply to all goods and services supplied by Wadebridge Bathroom Studio Ltd, also trading as WBS & www.wadebridgebathrooms.co.uk

1.2 No legally binding contract will exist between you and the above for the sale of any goods until, at least, a deposit has been received and accepted.
1.3 By way of clarification, an acknowledgement/invoice will be sent to you when your order is placed. Acceptance of this offer to purchase goods will only be confirmed and legally binding when your payment is received and you receive confirmation that you order has been accepted and processed. The order then becomes subject to these terms & conditions.
1.4 The contract is subject to your right of cancellation (see below)
1.5 We reserve the right to change these terms of sale without notice to you in relation to sales.
2.1 The description and price of the goods you order will be as shown on your acknowledgement. We reserve the right to substitute product from certain suppliers if these products are generic or identical or from the same manufacturer but called something other than what is on the order from another supplier.
2.2 The goods are subject to availability. If the goods are not available from stock for your order, an acknowledgement/Quote/email will state an estimated delivery date to you. We will not be held responsible for non-delivery of goods that pass our estimated delivery date because of factors beyond our control. You do have the right to cancel the order in respect of non-delivery (see below).
2.3 Every effort is made to ensure that the prices are current at the time of you placing your order. If an error is found, we will contact you as soon as possible and offer you the option on accepting the new price or cancelling the item in question.
2.3 In addition to the price, you may be required to pay a delivery charge. This will be based on where the delivery is in mainland Britain, weight and/or size of goods. This price will be relayed to you upon request.
3.1 Payment for goods and delivery (where applicable) can be paid via all major credit cards (except Amex) and bank transfer systems or at the studio.
3.2 Bank cheques will be accepted, but goods may not be dispatched until the cheque has cleared through the banking system, this will take approximately 5-7 working days. When paying by cheque, you may be notified by e-mail or phone call when the cheque has cleared and that your order has been released/dispatched.
3.3 Under normal conditions, no delivery will be made without cleared funds being received. Delivery before cleared funds is at the discretion of WBS staff.
3.4 Final payment automatically becomes due when your final goods (or part order thereof), are available for collection or ready for delivery. In the event of goods being delivered/collected before final payment is received, you have 7 days to settle the outstanding amount. We reserve the right to take further action to recover any monies owed after this time and charge interest on the debt if applicable.
4.1 The goods you order will be delivered to the address indicated on your order (weekends and bank holiday deliveries are at the discretion of WBS.) The driver will only offload goods to a ground level and is not obliged to carry goods up or down stairs. It is recommended that you arrange for other persons to be available to help carry larger or heavier goods, as the driver will always be working alone.
4.2 If delivery cannot be made to the address on your order, we will notify you as soon as possible for an alternative address. If no alternative address is available the goods will be held for you until notified of the new address or collected.
4.3 If you fail to take delivery because you no longer require the goods without prior arrangement, the goods will be credited within 30 days minus a 50% handling, delivery and re-stocking charge.
4.4 We will not be held liable for any loss or damages suffered by you in respect of reasonable or unavoidable delays in delivery.
4.5 On receipt of your order you will be asked to check the goods and verify they have been received in good condition. BATHS MUST BE CHECKED BEFORE ACCEPTANCE. No bath/s delivered to you can be returned as damaged after goods have been accepted, unless due to manufacturers faults. If the package does not appear to be in good condition you may investigate the package further or reject the delivery. You may not sign for the delivery and mark “UNCHECKED”. Failure to check may affect any claim made thereafter.
4.6 After taking delivery of you order, you have 48 hours to notify us of shortages and damages (which were not able to be checked on receipt, not including baths). You may email or telephone us and report the problems experienced. We will then endeavour to solve the problems as soon as possible. If you fail to notify us in this time period the order will be deemed complete and in good condition.
5.1 The goods are at your risk from the time of delivery.
5.2 Ownership of the goods shall not pass to you until full payment of all sums due in relation to the goods delivered is made. WBS reserve the right to withhold all warranties and guarantees until these payments are made.
5.3. Once goods have been fitted or installed, it is assumed that they have been accepted by you as fit for purpose and will only be replaced if proved to be faulty.
5.4 We do not accept any liability for any additional removal or re-fitting costs that may be involved in replacing any item that was originally accepted as fit for purpose.
6.1 You have the right to cancel an order at any time prior to goods being received by WBS for you.
6.2 To exercise your right of cancellation, we must receive written confirmation to the effect by email, fax or post specifying order reference (where applicable) and goods to be cancelled, notification by phone alone may not be accepted.
6.3 Except in the case of faulty or mis-described goods, if you exercise your right after receipt of goods, you will responsible for returning the goods to us at your own cost. The goods must be returned to WBS.
These goods may be subject to a re-stocking charge of up to 35% and will be credited/taken off of invoices when goods have been received back in good condition, unopened and in original packaging, if the goods are not received in a re-saleble condition on return no credit may be given.
6.4 Bespoke goods made to specific specifications (i.e whirlpool baths, special shower screens etc) cannot be returned unless faulty. It is therefore important you make absolutely sure the goods match the correct dimensions and specifications you require on ordering.
6.5 Once notification of cancellation has been received, we will refund or credit you within 30 days any sums owed to you.
6.6 Cancellations received for goods that are already in transit to you will be dealt with as a failure to take delivery, to which you will be liable for a re-stocking charge as in Delivery 4.3.
7.1 Once goods have been paid for and delivered/collected, we are under no obligation to accept back any goods which are not wanted by the customer.
7.2 With regard to tile orders, we will only accept back for credit, full boxes of tiles excluding;
7.2a Tiles which were specifically ordered in for the customer and not part of our normal stock holding.
7.2b Tiles which are not in original packaging and/or in resalable condition.
7.2c Tiles from different batch numbers to what is currently in stock.
8.1 All goods and services supplied or installed by us (under our project management service), are warranted free from defects for 12 months from the date of supply or installation (unless otherwise stated). In the case of installation (under our project management agreement), we warrant the work for 12 months having deemed it to have been carried out with reasonable care and skill. This warranty does not affect your statutory rights as a consumer.
8.2 This warranty does not apply to any defect in the goods arising from fair or wilful damage, accident, negligence by you or a third party, use for any other purpose other than specified by the manufacturer, failure to follow manufacturers instructions or your own repairs or modifications carried out without manufacturers approval.
8.3 If the goods supplied to you develop a defect while under the warranty period, you should notify us in writing, as soon as the defect is found. We will then respond and deal with your issue as soon as possible. (subject to full payment being received for the said item)
8.4 No warranty will be given on any goods supplied until full payment has been received.
9.1 Subject to 8.2, we will not be liable for any loss or damage in circumstances where;
9.1.1 there is no breach of a legal duty owed to you by us or our supplier, manufacturer or any of their agents;
9.1.2 such loss or damage is not a reasonably foreseeable result of any such loss or damage;
9.1.3 any increase in loss or damage resulting from a breach by you of any of the terms and conditions.
9.1.4. If payment has not been received in full before the date of the alleged fault.
We will take all reasonable precautions to keep the details of your order secure, but unless we are negligent, we will not be liable for any access to information supplied by you.
